Waiver Policy
A. MEDIA WAIVER
I grant permission to the Host Organization, NBA Canada and Canada Basketball, their officers, officials, agents, and employees, other
participants, sponsoring agencies, advertisers, and if applicable, owners and lessors of premises used to conduct the activities or events (the
“Releasees”) to collect the name, voice, statements, photograph, image, likeness, and actions of the Participant, in whole or in part, for
promotional, commercial, or other use, in perpetuity worldwide on standard and non-standard TV, video, print, electronic, and online media
(including the internet) and in any other means of distribution, publication or exhibition, whether known or hereinafter created without
additional consideration in connection with the Releasees and the marketing, advertising, and promotion thereof.
B. ASSUMPTION OF RISK
I am aware that the Participant’s involvement in the activities and events involve many risks, dangers and hazards including but not
limited to: accidents on or near the court, accidents at the facility, transportation to and from the facility, the negligence of the other
players or other parties participating, negligence on the part of the Releasees including the failure to safeguard and protect from the risks,
dangers and hazards. I freely accept and fully assume all risks, dangers and hazards associated with the Participant’s involvement in the
activities and the possibility of personal injury, death, property damage or loss resulting therefrom. I will be responsible for all medical costs
and expenses following, directly or indirectly, from participation in the activities outside of the insurance coverage provided through the
national and provincial membership in the Jr. NBA Player Package. I understand that if I know or suspect that my physical condition may
be incompatible with the activities that I should seek medical advice before undertaking said activities.
C. RELEASE OF LIABILITY
In consideration, the Participant’s involvement in the activities and permitting the use of the equipment and facilities of the Host
Organization, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I agree as follows:
TO WAIVE ANY AND ALL CLAIMS that the Participant has or may have in the future against the Releasees and to RELEASE THE RELEASEES from
any and all liability for any loss, damage, expense or injury including death that the Participant may suffer or that my next of kin may suffer
as a result of my participation in the activities, due to any cause whatsoever, including negligence, breach of contract, breach of any
statutory or other duty of care including under the Occupiers Liability Act on the part of the Releasees and further,
INCLUDING FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD AND PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE
ACTIVITIES. I agree to hold harmless and to indemnify the Releasees from any and all liability for property damage or personal injury to any
third party resulting from my participation in the activities. I agree that this agreement shall be binding upon my heirs, next of kin, executors,
administrators and assigns in the event of my death. I agree that this agreement shall be governed and interpreted in accordance with the
laws of the Province of Ontario and any litigation involving the parties to this agreement shall be brought in Ontario. In entering into this
agreement I am not relying on any oral or written representation or statements made by the Releasees with respect to the safety of the
Basketball Activities other than as set forth in this agreement.

Refund Policy
1. Introduction
This Refund Policy (the “Policy”) outlines the terms and conditions governing refunds issued by Wave Basketball Club (hereinafter referred to as the “Club”) to those participating in any of its programs (hereinafter referred to as the “participant” or “participants”) in accordance with applicable laws and regulations. By registering in or participating in any programs, events, or activities offered by the Club, participants agree to abide by the terms and conditions set forth herein.
2. Refund Eligibility
2.1. Jerseys, Jersey Packages, and Other Material Goods: Fees for jerseys, jersey packages, and other material goods (including but not limited to Reversible Club Training Jersey, Jr. NBA Jersey + Ball Package, and Club Team Jerseys) are non-refundable. However, exchanges for purchased jerseys, jersey packages, and other material goods may be permitted by the Club. Participants must adhere to the following conditions for exchanges of items mentioned in this section to be considered:
a. Items must be in their original, unused condition, with all tags and labels intact.
b. Requests for merchandise exchanges must be made within 30 days of the original purchase date.
c. Participants requesting an exchange for a different size or jersey must pay a processing fee of at least $15 per item to cover handling and restocking costs.
d. The availability of replacement merchandise is subject to stock on hand.
2.2. Programs: Refunds for programs (including but not limited to Jr. NBA Programs, Wave Basketball Training Academy, Game Day Training, Club Teams, Girls’ Program, and Adapted Program), may be considered subject to the following conditions:
a. Cancellation by the Club: In the event that the Club cancels a program or event, participants registered in said program or event will be entitled to a full refund of any fees paid, less any non-recoverable expenses incurred by the Club.
b. Pro-Rata Refunds: If a participant is unable to continue participation in a program or event, the Club may consider a pro-rata refund of fees paid for the remaining duration of the program or event, less any non-recoverable expenses incurred by the Club and a $29.95 processing fee. However, the club must be provided at least 30 days’ notice before the cessation of participation by the participant.
c. Non-Attendance: No refunds will be provided for participants who do not attend or complete a program or event for any reason, including personal scheduling conflicts, voluntary withdrawal, or any other personal reasons.
d. Withdrawal by the participant before the initial session: Participants will be provided with a full refund, minus a $29.95 processing fee, if they notify the club of withdrawal from the program at least 30 days prior to the first session.
2.2.1 Program Exchanges: In the event a participant no longer can attend a program they have registered for the participant has the option to switch to an alternate program. The Club will approve this exchange at their discretion. All program exchanges are subject to the following conditions:
a. Differences in cost between the programs must be paid to the Club by the participant.
b. Withdrawing the participant from their initial program does not jeopardize the Club’s ability to properly run the initial program.
c. The new program is not full.
d. The participant pays a $29.95 fee to the Club for administrative and processing expenses.
2.2.2 Single Session Absences. In the event of a medical emergency that causes a participant to miss a session, the Club may allow a participant to select a date to have a make-up session. Make-up sessions are subject to the following conditions:
a. Proof of Medical Event: If a participant is unable to participate in a session due to a medical condition or emergency that is confirmed by a licensed medical professional and prevents the participant from participating, the Club may consider a make-up session.
b. No make-up sessions will be granted for absences due to non-medical reasons, unless under extremely extenuating circumstances.
3. Refund Process
3.1. Request for Refund: To request a refund, Participants must submit a written refund request to the Club. The request should include the Participant’s name, program or event details and the reason for the refund request.
3.2. Approval Process: The Club will review refund requests within a reasonable time frame. Decisions regarding refunds will be made at the Club’s sole discretion, and the Club reserves the right to deny any refund request that does not meet the criteria outlined in this Policy.
3.3. Refund Method: Approved refunds will be processed using a payment method that is up to the Club’s discretion. Refunds will be issued in accordance with the Club’s internal processes and timelines.
4. Modification or Termination of Programs and Events
The Club reserves the right to modify, cancel, or terminate any program or event, in whole or in part, at its discretion. In such cases, the Club will make reasonable efforts to provide alternative arrangements or refunds, as applicable, based on the circumstances.
5. Changes to the Policy
The Club reserves the right to amend or update this Refund Policy. By participating in any programs, events, or activities offered by Wave Basketball Club, participants acknowledge that they have read, understood, and agreed to the terms and conditions of this Refund Policy.
This Refund Policy is effective as of Feb 23, 2024, and supersedes any prior refund policies issued by the Club.
